Born in New York City, New York
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
Under English Law those found guilty of treason
1. That the offender be drawn (dragged) to the gallows, and not be carried or walk.
2. That he be hanged by the neck, and then cut down alive.
3. That his entrails be taken out, and burned, while he is yet alive.
4. That his head be cut off.
5. That his body be divided into four parts.
6. That his head and quarters be at the king's disposal.

Why Amendment VIII - Punishment Fit the Crime might be annoying:

Some argue that any punishment is cruel and unusual.
It is sometimes arbitrary as to what is excessive bail or fines.
A loophole is that the court does not have to offer bail.
The amount of fines only applies to criminal cases, thus amounts in civil law suits can be outrageous.

Why Amendment VIII - Punishment Fit the Crime might not be annoying:

Punishment must fit the crime.
Prior to this right just about every felony was punished by the death penalty.
It did away with cruelty.
It limits extreme governmental abuse on criminals.
It eliminates legal brutality and torture.
